TERMs of use Inspect App & Services

These Terms of Use (“Terms”) govern your access to and use of the Inspect mobile application, Inspect Pro features, cloud processing, inspection reports, Speed Review™, and related app-based services provided by Raccoon Machines (“Raccoon,” “we,” “us,” or “our”) (collectively, the “Inspect Services”).

By accessing or using the Inspect Services, you agree to these Terms. If you do not agree to these Terms, do not use the Inspect Services.

These Terms apply to the Inspect Services only. Purchases, shipping, returns, warranties, refunds, and other terms relating to physical products or promotional packages purchased from Raccoon Machines are governed by our separate Terms of Sale and related store policies.

Access to Inspect Pro or other Inspect Services obtained through a promotional package remains subject to these Terms once activated or used.

1. The Inspect Services

Inspect is a visual vehicle inspection and documentation tool.

The Inspect Services may allow you to capture vehicle inspection media, organize inspection content, add notes or marks, upload content for cloud processing, generate reports, create shareable report links, and use automated or computer-assisted inspection features.

Available features may vary based on your device, app version, subscription status, location, or service availability.

We may add, modify, limit, suspend, or discontinue features of the Inspect Services at any time.

2. Inspect Is a Visual Documentation Tool

Inspect is designed to help users capture, review, organize, and share visual information about a vehicle.

Inspect is not a vehicle safety certification service, mechanical inspection service, engineering service, appraisal service, diagnostic service, or substitute for an inspection performed by a qualified automotive professional.

The Inspect Services do not determine whether a vehicle is safe, roadworthy, mechanically sound, structurally sound, legally compliant, or suitable for purchase, sale, operation, or repair.

You remain responsible for deciding whether additional inspection, diagnosis, testing, maintenance, or professional evaluation is necessary.

3. Limitations of Visual Inspection

Inspect can only process or display conditions that are captured and sufficiently visible in Inspection Content.

Vehicle defects, damage, corrosion, leaks, wear, structural conditions, mechanical problems, or unsafe conditions may be hidden, obstructed, internal, intermittent, outside the camera view, poorly illuminated, visually ambiguous, or otherwise impossible to identify from Inspection Content.

Image quality, camera position, lighting, motion, dirt, protective coatings, vehicle components, environmental conditions, device limitations, and user technique may affect inspection results.

The absence of a visible condition in Inspection Content does not mean that the condition is absent from the vehicle.

4. Automated Features and Speed Review™

The Inspect Services may include automated, computer-assisted, computer vision, artificial intelligence, image processing, or similar features, including Speed Review™.

These features may organize, filter, prioritize, enhance, summarize, mark, or highlight portions of Inspection Content.

Automated features may be incomplete, inaccurate, or incorrect.

They may fail to identify visible defects or conditions. They may incorrectly highlight normal vehicle components or conditions. They may omit relevant portions of an inspection or prioritize content that is not important.

The absence of an automated highlight, alert, mark, observation, or other output does not mean that a defect, unsafe condition, damage, corrosion, leak, wear, or other issue is absent.

Automated outputs are provided as review assistance only and should not be relied upon as a vehicle diagnosis, safety determination, mechanical opinion, engineering conclusion, or professional inspection result.

You are responsible for reviewing Inspection Content and determining whether professional inspection or additional evaluation is appropriate.

5. Inspection Reports

The Inspect Services may generate reports based on Inspection Content and information provided by you.

Inspection Reports are visual documentation and review tools. They are not certifications, warranties, guarantees, appraisals, vehicle history reports, mechanical diagnoses, or statements that a vehicle is free from defects.

A report reflects only the Inspection Content and information available to the Inspect Services at the time the report is generated.

Raccoon does not independently verify the vehicle, the identity of the person performing the inspection, the completeness of the inspection, the accuracy of user-provided information, or the condition of areas not visible in Inspection Content.

You should not rely solely on an Inspection Report when purchasing, selling, operating, repairing, financing, insuring, or making safety-related decisions about a vehicle.

6. Shareable Report Links

Inspection Reports may be made available through unique, non-indexed report links.

Anyone who obtains or receives a report link may be able to access the report without creating an account or signing in.

Report links are designed for convenient sharing and should be treated as access links. You are responsible for deciding who receives a report link and how you share it.

We do not guarantee that a report link will remain confidential if you or another person shares, forwards, publishes, copies, or otherwise distributes the link.

We may disable, expire, remove, or modify report access when reasonably necessary to operate or protect the Inspect Services.

7. Inspection Content and User Content

“User Content” includes photos, videos, inspection media, notes, comments, marks, labels, vehicle information, and other content that you capture, upload, submit, or provide through the Inspect Services.

You retain your rights in your User Content.

By submitting User Content to the Inspect Services, you grant Raccoon a non-exclusive, worldwide, royalty-free license to host, store, copy, process, reproduce, modify, transform, transmit, and display User Content as reasonably necessary to provide, operate, maintain, secure, troubleshoot, and improve the Inspect Services.

This license does not transfer ownership of your User Content to Raccoon.

You represent that you have the right to capture, upload, submit, and share User Content through the Inspect Services.

8. Personal, Sensitive, and Unrelated Content

The Inspect Services are intended for vehicle inspection content.

You must not intentionally use the Inspect Services to capture, upload, store, or distribute personal, sensitive, confidential, intimate, illegal, or unrelated content.

Do not use Inspect to upload government identification, financial information, medical information, passwords, security credentials, private or intimate images of people, explicit sexual content, or other content unrelated to vehicle inspection.

Inspection Content is not intended to contain personal or sensitive information. However, content you choose to capture or write may include such information.

You are responsible for reviewing what you capture, upload, write, and share.

We may remove content or restrict access to content that violates these Terms or is unrelated to the intended use of the Inspect Services.

9. Acceptable Use

You may not use the Inspect Services to:

  • violate any law or regulation;

  • infringe the rights of another person;

  • upload or distribute content you do not have the right to use;

  • capture or distribute unlawful, abusive, exploitative, or explicit content;

  • interfere with or disrupt the Inspect Services;

  • attempt to gain unauthorized access to systems, reports, accounts, or infrastructure;

  • probe, scan, or test vulnerabilities without authorization;

  • reverse engineer or circumvent technical limitations except where applicable law expressly permits it;

  • use automated systems to scrape, copy, harvest, or extract reports or service data without permission;

  • impersonate another person or misrepresent the source, completeness, or nature of an inspection;

  • use Inspect Reports to falsely represent that Raccoon has certified, approved, inspected, or guaranteed a vehicle.

10. Vehicle Safety and Use Around Vehicles

You are responsible for safely accessing, positioning, and operating around any vehicle.

Inspect and the Inspect Services do not replace proper vehicle safety procedures.

Do not place any part of your body beneath a vehicle unless the vehicle has been properly supported using equipment and procedures appropriate for that vehicle.

Do not rely on a vehicle's suspension, parking brake, transmission position, hydraulic jack, or the Inspect Services as a substitute for appropriate vehicle support and safety procedures.

You are responsible for the conditions in which you perform an inspection, including traffic, vehicle movement, hot components, rotating components, sharp surfaces, fluids, electrical systems, environmental hazards, and other risks associated with vehicles.

11. Inspect Pro subscription and Paid Features

Certain Inspect features may require an Inspect Pro subscription or other paid access.

The price, subscription period, available features, and renewal terms will be presented in the Inspect app before you complete a purchase.

Inspect Pro subscriptions purchased through Apple are billed and processed by Apple and are subject to Apple's applicable payment and subscription terms.

Unless cancelled, an auto-renewable Inspect Pro subscription may automatically renew in accordance with the terms presented at the time of purchase and Apple's applicable subscription rules.

You may manage or cancel an Apple-billed Inspect Pro subscription through your Apple account and subscription settings.

Cancellation stops future renewal. Deleting the Inspect app does not cancel an active subscription.

Refund requests for purchases billed and processed by Apple are handled through Apple's applicable refund processes and are subject to Apple's eligibility requirements and decisions.

Raccoon does not independently issue refunds for transactions billed and processed by Apple.

We may change the features included in free or paid service tiers. Changes affecting active paid access will be handled as required by applicable law and, where applicable, the terms of the platform through which the purchase was processed.

12. Promotional and Included Access

Raccoon may provide trial periods, promotional access, offer codes, included Inspect Pro access, or other limited offers.

Promotional or included access may be provided in connection with a physical product, promotional package, marketing offer, or other eligible promotion.

Promotional or included access may have an expiration date, activation period, eligibility requirement, redemption requirement, or other limitation disclosed with the applicable offer.

Unless otherwise stated, promotional or included access has no separate cash value, may not be transferred or resold, and may be limited to one use per user, device, account, purchase, or promotion.

Once promotional or included Inspect Pro access is activated or redeemed, your use of that access is governed by these Terms.

The purchase, cancellation, return, or refund of a physical product or promotional package through which promotional access was provided is governed by the applicable Terms of Sale and Return & Refund Policy, not by this Section.

We may reject, disable, or revoke promotional access obtained through fraud, abuse, unauthorized resale, duplicate redemption, or circumvention of offer limitations.

13. Service Availability

The Inspect Services may depend on internet connectivity, cloud infrastructure, third-party services, device capabilities, operating system features, and other systems outside our direct control.

We do not guarantee that the Inspect Services, report generation, uploads, processing, automated features, or report links will always be available, uninterrupted, error-free, or completed within a specific period of time.

Inspection Content may fail to upload, process, generate, display, or remain available.

You should retain original media or other records when continued access is important to you.

14. Intellectual Property

The Inspect Services, including the Inspect app, software, designs, interfaces, workflows, processing systems, report formats, branding, logos, and related technology, are owned by Raccoon or its licensors and are protected by applicable intellectual property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Inspect Services for their intended purpose.

Except for your User Content, you may not copy, modify, distribute, sell, license, or create derivative works from the Inspect Services except as expressly permitted by us or applicable law.

15. Feedback

If you provide ideas, suggestions, comments, or other feedback about the Inspect Services, you may do so voluntarily.

You grant Raccoon the right to use that feedback without restriction or compensation to develop, improve, or promote our products and services.

16. Suspension and Termination

We may suspend, limit, or terminate access to the Inspect Services if we reasonably believe you have violated these Terms, created a security or legal risk, abused the Inspect Services, or used the Services in a manner inconsistent with their intended purpose.

You may stop using the Inspect Services at any time.

Termination of access does not automatically require us to retain Inspection Content or reports indefinitely.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE INSPECT SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

RACCOON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE INSPECT SERVICES WILL IDENTIFY ANY OR ALL VEHICLE DEFECTS, DAMAGE, CORROSION, LEAKS, WEAR, SAFETY CONDITIONS, OR MECHANICAL CONDITIONS.

WE DO NOT WARRANT THAT AUTOMATED FEATURES, SPEED REVIEW™, INSPECTION REPORTS, OR OTHER OUTPUTS WILL BE COMPLETE, ACCURATE, OR ERROR-FREE.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACCOON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, USE, BUSINESS OPPORTUNITY, OR VEHICLE VALUE ARISING OUT OF OR RELATED TO THE INSPECT SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACCOON WILL NOT BE LIABLE FOR VEHICLE DEFECTS, DAMAGE, CORROSION, LEAKS, MECHANICAL FAILURE, STRUCTURAL FAILURE, ACCIDENTS, PERSONAL INJURY, PROPERTY DAMAGE, PURCHASE OR SALE DECISIONS, REPAIR DECISIONS, OR OTHER LOSSES BASED ON RELIANCE ON INSPECTION CONTENT, AUTOMATED FEATURES, SPEED REVIEW™, OR INSPECTION REPORTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACCOON'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE INSPECT SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO RACCOON FOR THE INSPECT SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Raccoon and its officers, directors, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses arising from your User Content, your misuse of the Inspect Services, your violation of these Terms, or your violation of another person's rights.

20. Privacy

Our collection and use of information through the Inspect Services is described in our Privacy Policy — Inspect App & Services.

21. Apple-Specific Terms

The following terms apply to your use of the Inspect mobile application obtained through the Apple App Store.

Acknowledgement

You acknowledge that these Terms are concluded between you and Raccoon only, and not with Apple. Raccoon, not Apple, is solely responsible for the Inspect application and its content.

These Terms are not intended to provide usage rules for the Inspect application that conflict with the Apple Media Services Terms and Conditions or other applicable Apple usage rules.

Scope of License

Subject to these Terms, Raccoon grants you a limited, non-exclusive, non-transferable, revocable license to use the Inspect application on Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and Support

Raccoon, not Apple, is responsible for providing any maintenance and support services for the Inspect application as specified in these Terms or required by applicable law.

You acknowledge that Apple has no obligation to provide maintenance or support services for the Inspect application.

Warranty

To the extent any warranty applies to the Inspect application and the application fails to conform to that warranty, you may notify Apple, and Apple may refund the applicable purchase price for the Inspect application, if any, as provided under Apple's applicable terms.

To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Inspect application.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure of the Inspect application to conform to an applicable warranty are the responsibility of Raccoon to the extent required under these Terms or applicable law.

Product Claims

You acknowledge that Raccoon, not Apple, is responsible for addressing claims by you or a third party relating to the Inspect application or your possession or use of the Inspect application, including product liability claims, claims that the Inspect application fails to conform to applicable legal or regulatory requirements, and claims arising under applicable consumer protection, privacy, or similar laws.

Nothing in this Section expands Raccoon's liability beyond the obligations or limitations provided in these Terms or applicable law.

Intellectual Property Claims

If a third party claims that the Inspect application or your possession or use of the Inspect application infringes that third party's intellectual property rights, Raccoon, not Apple, will be responsible for the investigation, defense, settlement, and discharge of the intellectual property infringement claim to the extent required by applicable law.

Legal Compliance

You represent and warrant that:

  • you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a “terrorist supporting” country; and

  • you are not listed on any United States Government list of prohibited or restricted parties.

Third-Party Terms

You must comply with applicable third-party terms when using the Inspect application, including applicable wireless data, internet service, device, operating system, and Apple terms.

Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to the Inspect application.

Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

22. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the “Last updated” date and may provide additional notice through the Inspect app or our website.

Your continued use of the Inspect Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

23. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Inspect Services will be subject to the jurisdiction of the state and federal courts located in Pennsylvania, except where applicable law requires otherwise.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

25. Entire Agreement

These Terms, together with the Privacy Policy — Inspect App & Services and any additional terms expressly presented for specific Inspect features, constitute the agreement between you and Raccoon regarding the Inspect Services.
