These Terms of Sale (“Terms”) govern purchases of physical products from Raccoon Machines (“Raccoon,” “we,” “us,” or “our”) through the Raccoon Machines website and related online checkout and commerce services (collectively, the “Store Services”).
By placing an order through the Store Services, you agree to these Terms.
These Terms apply to physical products and related commerce transactions only. Use of the Inspect mobile application, Inspect Pro, Speed Review™, cloud processing, inspection reports, and related app-based services is governed by our separate Terms of Use — Inspect App & Services.
Our checkout and certain commerce functions are powered by Shopify. Use of Shopify-powered checkout may also be subject to applicable terms and policies of Shopify and payment providers.
1. Products
Raccoon Machines designs, assembles, and sells vehicle inspection tools and related physical products, including the Inspection Kit.
We make reasonable efforts to accurately describe and display our products. Product images, illustrations, dimensions, materials, colors, finishes, components, packaging, and other details may vary slightly from the product you receive.
We may make changes to product design, materials, components, manufacturing methods, packaging, or specifications where the changes do not materially alter the intended function of the product.
Product availability is not guaranteed.
2. Orders
Your submission of an order is an offer to purchase the products identified in your order.
We may accept, reject, limit, or cancel an order for legitimate reasons, including product availability, suspected fraud, pricing or listing errors, payment issues, shipping restrictions, suspected resale abuse, or other operational or legal reasons.
An order confirmation does not necessarily mean that we have accepted or shipped your order.
If we cancel an order after payment has been collected, we will provide an applicable refund to the original payment method.
You are responsible for providing accurate and complete contact, billing, and shipping information.
3. Prices and Payment
Prices are displayed in the currency shown at checkout.
Prices, promotions, product availability, and offers may change without notice before an order is placed.
Applicable taxes, shipping charges, duties, or other charges will be displayed or calculated where available and may depend on the destination and applicable law.
Payment is processed through Shopify-powered checkout and applicable payment providers.
We may not directly receive or store your complete payment card information.
You authorize the applicable payment provider to charge the payment method selected at checkout for the total amount of your order.
4. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy.
Shipping dates and delivery estimates are estimates only and are not guaranteed.
Delivery times may be affected by carriers, weather, address issues, customs, transportation disruptions, product availability, or other circumstances outside our reasonable control.
Risk of loss and title to products pass as provided by applicable law and the shipping terms applicable to your order.
You are responsible for providing a complete and accurate delivery address.
5. Returns and Refunds
Returns, exchanges, and refunds are governed by our Return & Refund Policy.
You should review the Return & Refund Policy before placing an order.
Physical product returns do not automatically cancel, refund, or modify subscriptions, digital purchases, or other paid app-based services unless expressly stated otherwise.
If a physical product includes promotional, trial, or limited access to Inspect Pro or another app-based feature, the effect of a return on that access may be described in the applicable offer or Return & Refund Policy.
6. Inspection Kit Intended Use
The Inspection Kit is a vehicle inspection accessory designed to assist with positioning a compatible mobile device for visual vehicle inspection and documentation.
The Inspection Kit is not vehicle lifting equipment, vehicle support equipment, a jack, jack stand, wheel restraint, safety stand, securing device, or personal protective equipment.
The Inspection Kit is not designed or intended to support the weight of a vehicle or any part of a vehicle.
Do not use the Inspection Kit to lift, support, secure, stabilize, stop, or restrain a vehicle.
Do not intentionally drive a vehicle over the Inspection Kit or place the Inspection Kit where it may interfere with vehicle movement, steering, braking, rotating components, or traffic.
7. Vehicle Safety
Vehicles and vehicle inspection environments may present serious risks, including vehicle movement, hot surfaces, sharp components, rotating components, electrical systems, pressurized systems, fluids, chemicals, road traffic, and unstable working conditions.
You are responsible for selecting a safe inspection location and following appropriate vehicle safety procedures.
Never place any part of your body beneath a vehicle unless the vehicle has been properly supported using equipment and procedures appropriate for that vehicle.
Do not rely solely on a parking brake, transmission position, vehicle suspension, or hydraulic jack when appropriate vehicle support is required.
Raccoon does not provide vehicle lifting, repair, or professional automotive safety instructions through the sale of the Inspection Kit.
You are responsible for determining whether your intended use of a product is safe and appropriate for your vehicle, environment, device, and circumstances.
8. Mobile Devices and Compatibility
The Inspection Kit may be designed for use with compatible mobile devices.
Compatibility may depend on device size, dimensions, case design, camera location, accessories, operating system, or other device characteristics.
You are responsible for confirming compatibility before use.
Unless expressly stated otherwise, mobile phones and other electronic devices are not included with the Inspection Kit.
Raccoon is not responsible for damage caused by improper installation, incorrect positioning, incompatible devices or cases, failure to secure a device, misuse, collision with a vehicle or other object, or use outside the product's intended purpose.
Inspect your device and the Inspection Kit before use and discontinue use if any component appears damaged, excessively worn, loose, cracked, or unable to securely perform its intended function.
9. Relationship to the Inspect App
The Inspection Kit and the Inspect mobile application are related products but are governed by separate terms.
The Inspection Kit may be used with the Inspect app where compatible. Certain physical products may also be usable with a device's native camera or other compatible camera functionality.
Purchase of an Inspection Kit does not guarantee perpetual access to any particular Inspect app feature, cloud service, automated feature, or paid service tier.
Use of the Inspect app and related app-based services is governed by the Terms of Use — Inspect App & Services and Privacy Policy — Inspect App & Services.
10. Included or Promotional Inspect Pro Access
Certain products or promotions may include limited Inspect Pro access, a promotional code, trial access, or another app-based benefit.
The specific duration, activation requirements, eligibility, and limitations of included or promotional access will be described with the applicable product or offer.
Unless expressly stated otherwise, included or promotional access:
has no cash value;
may not be exchanged for cash;
may not be resold or transferred;
may be subject to an activation period or expiration date;
may be limited to one activation per eligible purchase, user, account, or promotion.
Inspect Pro access and app-based features are governed by the Terms of Use — Inspect App & Services.
We may reject or disable promotional access obtained through fraud, unauthorized resale, duplicate redemption, or circumvention of offer limitations.
Certain promotional packages may combine a physical product with included or promotional Inspect Pro access and may be sold and priced as a single offer.
Unless expressly stated otherwise with the applicable offer, components of a promotional package are not separately returnable or separately refundable and do not have independently refundable cash value.
The return, cancellation, and refund conditions applicable to a promotional package are governed by the Return & Refund Policy and any additional terms disclosed with the applicable offer.
11. Product Care, Inspection, and Maintenance
You are responsible for inspecting the product before each use.
Do not use a product that is damaged, cracked, deformed, excessively worn, improperly assembled, or missing required components.
Normal wear may occur through use around pavement, concrete, vehicle components, dirt, debris, moisture, and other inspection environments.
You are responsible for cleaning, storing, and maintaining the product in a manner appropriate for its intended use.
Unauthorized modification or use of non-compatible replacement parts may affect product performance and may void any applicable limited warranty to the extent permitted by law.
12. 90-Day Limited Warranty
Raccoon warrants to the original purchaser that the physical product will be free from material defects in materials and workmanship under normal intended use for a period of 90 days from the date of delivery.
This limited warranty does not cover:
normal wear and cosmetic changes;
scratches, discoloration, surface wear, or finish changes resulting from normal use;
damage caused by misuse, abuse, neglect, or improper storage;
damage caused by a vehicle, vehicle movement, impact, crushing, excessive force, heat, chemicals, or environmental exposure;
damage caused by modification, disassembly, improper repair, or use of incompatible parts;
damage to a mobile phone, case, camera, or other third-party device;
products purchased from unauthorized resellers where permitted by applicable law.
Our obligation under this limited warranty is limited, at our option, to repair, replacement, or refund of the affected physical product.

This limited warranty gives you specific legal rights. You may also have other rights that vary by jurisdiction.
13. No Professional Inspection or Vehicle Condition Warranty
The sale or use of an Inspection Kit does not mean that Raccoon has inspected, approved, certified, or evaluated any vehicle.
Raccoon does not warrant that use of the Inspection Kit will reveal any or all vehicle defects, corrosion, damage, leaks, wear, structural conditions, mechanical problems, or unsafe conditions.
The Inspection Kit is a positioning and documentation accessory. Inspection results depend on camera position, lighting, visibility, user technique, vehicle configuration, environmental conditions, and other factors.
The absence of a visible condition does not mean that the condition is absent from the vehicle.
The Inspection Kit is not a substitute for inspection, diagnosis, or evaluation by a qualified automotive professional when such evaluation is appropriate.
14. Prohibited Uses
You may not use products purchased from Raccoon:
for an unlawful purpose;
as vehicle lifting or support equipment;
to intentionally support or bear vehicle weight;
in a manner inconsistent with the product's intended use;
after the product has become materially damaged or unsafe;
to falsely represent that Raccoon has certified, approved, inspected, or guaranteed a vehicle;
to infringe the rights of another person.
15. Intellectual Property
Raccoon Machines names, product names, logos, designs, product documentation, website content, photographs, illustrations, software-related materials, and other intellectual property are owned by Raccoon or its licensors and are protected by applicable intellectual property laws.
Purchasing a product does not transfer ownership of Raccoon's intellectual property.
You may use purchased physical products for their intended purpose.
You may not copy, reproduce, manufacture, commercially exploit, or create confusingly similar products using Raccoon's protected intellectual property except as permitted by applicable law.
16. Third-Party Products and Services
Our products or Store Services may be used with or reference third-party products or services, including mobile devices, operating systems, applications, payment services, shipping carriers, and Shopify-powered checkout.
Raccoon does not control and is not responsible for third-party products or services.
References to third-party products or services do not constitute a warranty or guarantee regarding those products or services.
17. Disclaimer and Limitation of Warranties
EXCEPT FOR THE EXPRESS LIMITED WARRANTY PROVIDED IN THESE TERMS OR WITH A PRODUCT, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRODUCTS AND STORE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE APPLICABLE EXPRESS LIMITED WARRANTY.
WE DO NOT WARRANT THAT A PRODUCT WILL IDENTIFY, REVEAL, OR ASSIST IN IDENTIFYING ANY OR ALL VEHICLE DEFECTS, DAMAGE, CORROSION, LEAKS, WEAR, MECHANICAL CONDITIONS, STRUCTURAL CONDITIONS, OR SAFETY ISSUES.
Some jurisdictions do not allow limitations on the duration of implied warranties, so the above limitation may not apply to you.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RACCOON WILL NOT BE LIABLE FOR CLAIMS OR DAMAGES ARISING FROM MISUSE OF A PRODUCT, USE OUTSIDE ITS INTENDED PURPOSE, FAILURE TO FOLLOW PRODUCT WARNINGS OR SAFETY INSTRUCTIONS, IMPROPER VEHICLE SUPPORT OR SECURING PROCEDURES, VEHICLE MOVEMENT, USE OF A DAMAGED PRODUCT, OR RELIANCE ON VISUAL INSPECTION RESULTS AS A SUBSTITUTE FOR APPROPRIATE PROFESSIONAL INSPECTION OR DIAGNOSIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACCOON'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO A PHYSICAL PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID TO RACCOON FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some limitations may not apply to you.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Raccoon and its officers, directors, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses arising from your misuse of a product, violation of these Terms, unlawful conduct, or violation of another person's rights.
20. Privacy
Our collection and use of personal information in connection with the Store Services is described in our Store Privacy Policy.
Information processed through the Inspect app or related app-based services is governed by the separate Privacy Policy — Inspect App & Services.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, Store Services, business practices, or applicable law.
The Terms applicable to a purchase are the Terms in effect when the applicable order is placed, except where changes are required by law.
We will post updated Terms and revise the “Last updated” date.
22. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles.
Any dispute arising out of or relating to these Terms, the Store Services, or a physical product will be subject to the jurisdiction of the state and federal courts located in Pennsylvania, except where applicable law requires otherwise.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
24. Entire Agreement
These Terms, together with the Store Privacy Policy, Shipping Policy, Return & Refund Policy, and any written product-specific warranty or terms presented at the time of purchase, constitute the agreement between you and Raccoon regarding purchases of physical products through the Store Services.
